Professional Career
Marius Vischer is a Swiss attorney with a practice centred on technology law, intellectual property and data protection. He was admitted to the Zurich Bar in 2016, following the successful completion of his legal studies at the University of Zurich and internships at the Swiss Competition Commission, a district court and a leading commercial law firm. Prior to joining the firm in 2018, he practised at one of Switzerland’s top-tier commercial law firms, where he gained broad experience in complex commercial matters and developed a particular focus in antitrust law.

Marius Vischer’s practice spans both transactional and contentious work — he advises on complex matters and, where needed, litigates them, appearing before civil courts, arbitral tribunals and regulatory authorities. He advises clients on cloud computing and outsourcing arrangements (SaaS, PaaS, IaaS), the legal dimensions of artificial intelligence (AI), data protection and cybersecurity matters, IT-related procurement law, intellectual property rights, and competition law. He also regularly delivers training programmes and workshops, with a particular focus on data protection and AI law.

Experience
During his career, Marius Vischer has, among others, carried out the following mandates:
- Structuring, drafting and negotiating complex IT procurement, cloud services (SaaS, PaaS, IaaS) and outsourcing agreements on both the supplier and client side.
- Advising clients on the legal and regulatory implications of artificial intelligence, including AI governance frameworks, automated decision-making and compliance with emerging AI regulation.
- Developing standard contract frameworks and general terms and conditions for IT vendors and e-commerce platforms.
- Serving as general outside counsel for technology companies, providing ongoing strategic legal advice across all business functions.
- Acting as external data protection officer for private companies and public bodies.
- Advising clients in the telecommunications sector, including in connection with the establishment and operation of mobile virtual network operators (MVNOs).
- Representing clients in court and arbitration proceedings involving contractual disputes, IT procurement challenges and intellectual property enforcement.
- Advising corporations and public bodies on data protection compliance and providing legal support in connection with cyberattacks and data breaches.
- Managing trademark portfolios including registrations, opposition proceedings and the negotiation of coexistence agreements.
- Supporting M&A transactions through legal due diligence, structuring and deal execution.
- Executing corporate formations and restructurings across a variety of industries.
- Advising and representing companies in proceedings before the Swiss Competition Commission, including merger control notifications and coordination across foreign jurisdictions.
