Professional Career<\/h2>\n\n\n\n

Marius Vischer joined our firm in 2018. After completion of his studies at the University of Zurich, he worked as an intern at the Competition Commission, a commercial law firm and a district court; he was admitted to the Zurich bar in 2016. Before he joined our firm, Marius Vischer worked as an attorney in a renowned Zurich commercial law firm, where, among other things, he gained specialised knowledge in antitrust law.<\/p>\n\n\n\n

Areas of Expertise<\/h2>\n\n\n\n

Marius Vischer reviews and drafts contracts, leads contract negotiations and represents clients in proceedings. His main focus is on legal advice in IT- and technology-related matters, contract law, procurement law, corporate law, competition and intellectual property law as well as data protection law. Marius Vischer is also the editor for IT law of Weblaw’s Digital Jurisprudence Commentary (Digitaler Rechtsprechungs-Kommentar<\/em>; <\/strong>dRSK) and regularly gives training courses and workshops, i.a. in data protection law.<\/p>\n\n\n\n

Handelsblatt and Best Lawyers feature Marius Vischer as one of the best lawyers in Switzerland for technology law and Leaders’ League recommends him in the areas of\u00a0TMT<\/a>\u00a0(“highly recommended”) und\u00a0Data Protection<\/a>\u00a0(“recommended”). Further, \u00a0WIPR Leaders 2024<\/a>\u00a0feature him as \u201cleading IP practiotioner\u201d in Switzerland.\u00a0\u00a0<\/p>\n\n\n\n

During his career, Marius Vischer has, among others, carried out the following mandates:<\/p>\n\n\n\n

  • Drafting, commenting and negotiating of various IT procurement, cloud (incl. SaaS, PaaS, IaaS) and outsourcing contracts on supplier and customer side.<\/li>\n\n\n\n
  • Drafting of standard contracts and general terms and conditions for IT and e-commerce suppliers (incl. platforms)<\/li>\n\n\n\n
  • General external counsel for enterprises in the IT industry<\/li>\n\n\n\n
  • Representation of clients in court and arbitration proceedings, i.a. linked to contractual, procurement or intellectual property disputes<\/li>\n\n\n\n
  • General advice on data protection law and advicing companies and municipalities in connection with cyber attacks (data breaches)<\/li>\n\n\n\n
  • Filing trademark registrations, conducting of opposition proceedings and negotiation of delimitation agreements<\/li>\n\n\n\n
  • Accompanying of M&A projects, participation in due diligence examinations<\/li>\n\n\n\n
  • Carrying out various company formations and restructurings<\/li>\n\n\n\n
  • Advising and representing companies in proceedings before the Competition Commission<\/li>\n\n\n\n
  • Representation of companies in merger control proceedings before the Competition Commission and coordination of notifications in foreign jurisdictions<\/li>\n<\/ul>\n\n\n\n
